Mr Watts said he and his wife paid a $5000 deposit for a lot in February 2013 and were told by the selling agent Terranovis that titles were expected to be issued in August 2013.

They approached a builder for house plans. But in June they received a letter saying titles would be delayed until January this year, which caused them to lose their deposit on their house plans.

‘January came around and still no titles,’ he said.

‘We already have been waiting seven months longer than when they were supposed to be issued.

‘I hope we don’t lose our second house plan deposit.

‘In the meantime, we are still renting at $500 a week.

‘It’s been a bit of a hassle.’

Terranovis director Anthony Mylonas said there had been reasonable grounds for the initial forecast of August 2013 for titles on lots in that stage.

But incidents such as delayed engineering plan approvals and on-site construction hold-ups had slowed proceedings.

He said Terranovis wrote regularly to buyers to explain the progress and to provide new forecasts.

Mr Mylonas said construction at the estate finished in February and Terranovis had been getting the necessary clearances to apply for titles.

They had received clearances from all authorities except the City of Gosnells, with which Terranovis was still working.

He said if all went well, he hoped titles would be available by late April.

‘We understand this is a frustrating time for buyers, as it is for us, seeing their lot practically completed, yet unable to settle their purchase due to the time taken to achieve the required checks and approvals from a range of local and state authorities,’ he said. ‘Terranovis are committed to achieving titles in the shortest possible timeframes. We don’t get paid until blocks settle.’

Mr Mylonas said buyers who signed up in February 2013 acknowledged in writing that the deadline for title issue was February 2015.

‘If a particular buyer wanted to get out of their contract, we are always willing to ask the seller for their consent,’ he said.
