Further legal action against Han’s Cafe chain

THE Fair Work Ombudsman has begun further legal action against the Han’s chain of Asian restaurants in Perth, alleging staff at the Armadale outlet were underpaid more than $67,000.

Phua and Foo Pty Ltd will face the Federal Court accused of underpaying 27 employees between December 2014 and September 2015.

The legal action comes after chain operator Tram Hoang Han and two associated companies were handed $37,500 in penalties for record-keeping practices that were so poor they prevented the workplace watchdog from determining the full extent of underpayments to overseas workers.

It also follows legal action alleging the franchisee of the Rockingham outlet Tac Pham Pty Ltd and general manager Cuc Thi Thu Pham diddled 22 employees out of almost $28,000 between December 2014 and December 2015.
