Fremantle’s south ward residents to go back to the polls after local government election result declared invalid

RESIDENTS in Fremantle’s south ward will go back to the polls on March 16, 2018 after the early election was found to be invalid.

In a court proceeding today the magistrates declared that the election on October 21 was invalid.

The Electoral Commissioner made a complaint about the election result after it found Ben Moodie, a candidate in the south ward, was not living in the area when he nominated.

Returning officer Jeff Clark and the WA Electoral Commission did not disqualify Mr Moodie at the time of nomination.

This is the first time an invalidity complaint has been lodged in a WA local election.

Andrew O’Sullivan, who was elected as the south ward councillor, previously told the Gazette he was “devastated” at the prospect of a by-election.
