Painting company, director fined for unregistered work

Jackal Nominees Pty Ltd and its director Fortunato Giovanni Del Fante, trading as Pedrini Painting – Del Fante, were each ordered to pay a $10,000 fine and $414.60 costs after facing Perth Magistrates Court on October 30.

The company pleaded guilty to four charges under the Building Services Act 2011 and Home Building Contracts Act 1991.

Del Fante was charged with the same four offences and pleaded guilty.

It is an offence to carry out unregistered painting work for payment of more than $1000, but the company carried out a $7968 contract in Marmion and $1955 contract in Como two years ago.

The company was registered in 2014 and Del Fante became a registered painting contractor and practitioner this year.

Further charges related to the company accepting a deposit for the Marmion contract of more than the allowed 6.5 per cent.

The company also implied it was entitled to carry out painting work when it was not.

Building commissioner Peter Gow said it was Del Fante’s responsibility to be aware of his legal obligations.
