“He assaulted me in my house and I helped him home,” Mr Kowitz told the court.

Police said a pathology report was still being prepared to determine the cause of Mr O’Reilly’s death.

Charges against Mr Kowitz could be upgraded, pending the outcome of the report.

Mr Kowitz is due back in court on July 24.

Police were called to the scene on June 20 just before 7am.

Residents said they were told not to leave their homes for most of the morning.

Major Crime Squad detectives and forensic officers were at the scene until late that evening.

Mr O’Reilly was listed to appear in Mandurah Magistrates Court on damaging property charges on the same day.

His case was dismissed.
