City of South Perth disappointed JDAP approval given to 34-storey building on Mill Point Rd

CITY of South Perth chief executive Geoff Glass says he is disappointed that a controversial 34-storey building on Mill Point Road has been approved but concedes the council cannot appeal it.

Following an 18-month period of discussions and court appeals, the Joint Development Assessment Panel (JDAP) approved the mixed-used Lumiere building on 74 Mill Point Road on October 19.

The project was approved by the JDAP after developer Edge Visionary Living submitted a revised plan that saw the building reduced in height from 44 storeys to 34 storeys and a reduction in the number of serviced apartments from 147 to 100.

The decision follows a ruling from WA Supreme Court Justice John Chaney that deemed planning approval for the apartment block did not comply with local planning laws relating to the size and purpose of the plot.

Mr Glass said the council recommended the refusal of the application because of a number of issues.

“The council strongly supported the refusal recommendation made by the officers and accordingly the City does not support the decision made by the JDAP,” he said.

“The decision made by JDAP is the final decision in the current State Administrative Tribunal (SAT) appeal process, which was between the applicant and JDAP.

“The City’s involvement was to reassess the applicant’s amended development application and provide recommendations to JDAP.

“The City has no further right of appeal to the SAT.”

Edge Visionary Living managing director Gavin Hawkins said he believed the decision was in line with proper and orderly planning and reaffirmed the integrity of the City of South Perth’s existing Town Planning Scheme.

“We listened to the concerns about height, so we decided that the best option was to reduce Lumiere under the height of the Civic Heart building as something that would be more acceptable,” he said.

“Lumiere is not only smaller in height, but it’s also smaller in scale when compared with Civic Heart, Glass House and the proposed development at 88 Mill Point Road.”
