Councillor cleared of Flynn Drive confidence breach

A CITY of Wanneroo investigation has found there was no breach of confidence at the council following allegations about a Flynn Drive report.

The Times reported on a call for Main Roads WA to take over the City’s Flynn Drive realignment project on May 26, which coincided with a confidential report about it on that night’s council meeting agenda.

The story prompted speculation that there had been a breach of confidence by one of the councillors, Linda Aitken, at a Two Rocks Yanchep Residents Association (TRYRA) meeting the night before.

At the August 18 council meeting, councillors accepted a report by the City’s governance manager Mustafa Yildiz on the investigation into the allegations.

“It is administration’s conclusion that there has been no breach of confidentiality or of the non-disclosure requirements of the rules of conduct (for elected members),” his report said.

It said the story in the Times revealed information “of a historical nature” based on earlier council reports and stories.

“They are matters which were previously in the public domain and therefore not matters which can be considered as confidential in essence,” it said.

Now available for inspection at the City’s offices, the report said TRYRA provided minutes, an email and a recording of the May 25 meeting for the investigation.

“On the basis of the recording of the meeting, there is no evidence that Cr Aitken discussed or mentioned anything in respect of the confidential council forum except stating that the council meeting she attended was in fact a confidential meeting,” it said.
