‘Hobby’ claim rejected

Robert Mark Thompson was fined $3000 and ordered to pay $3400 costs to Joondalup Magistrates Court on July 10 for running an unlicensed car dealership.

The court found he purchased 18 cars and sold 15 of them between October 2012 and April 2014 without having a licence as required by the Motor Vehicle Dealers Act.

Magistrate Brian Gluestein rejected the defence argument that Thompson's activities were a hobby rather than a business involving the buying and selling of vehicles.

Consumer Protection commissioner Anne Driscoll said backyard dealers were a danger to the community because the usual warranty and consumer protections were not available to their customers. "I urge consumers not to deal with unlicensed dealers," she said.
