Online sale of cars illegal

Gilbert Arnold Broadway was fined $4000 and ordered to pay costs of $3750 when he faced Joondalup Magistrates Court on March 30.

Broadway breached the Motor Vehicle Dealers Act when he bought 13 vehicles at auction and sold them on Gumtree between September, 2012 and April, 2014 without a dealers licence.

Consumer Protection commissioner Anne Driscoll warned consumers not to buy second-hand cars from sellers such as Broadway. Consumers who buy from unlicensed backyard dealers may be foregoing their right of a warranty on that vehicle and may have difficulties in getting a remedy if things go wrong soon after purchase, she said.

Illegal operators undermine industry standards and their activities should be reported immediately to Consumer Protection so that action can be taken, Commissioner Driscoll said.

The department said buyers could check the legality of car dealers at the web|site www.commerce.wa.gov.au/CP/|licencesearch.
