Planning 4Site Pty Ltd, applied to develop the vacant lot fronting the north eastern corner of the Nairn Drive and Safety Bay Road intersection in 2014, but it was rejected by the City and the South-West Joint Development Assessment Panel.
The proposal was considered by the panel three times before being rejected on October 2 last year.
The applicant lodged an appeal with the State Administrative Tribunal. The City and the panel were invited to reconsider the decision. As part of the reconsideration, the applicant provided additional information and a revised site layout plan, which resulted in a number of changes.
On Tuesday, councillors again voted in favour of the City officers’ recommendation that the proposal be refused, eight votes to two.

Cr Chris Elliott said the City had well- reasoned and composed planning policies that needed to be adhered to, and the application failed to comply with 10 of 26 necessary planning policies.
