Perth court: man jailed for filming rape of partner and sex with underage boy

A MAN who filmed himself raping his sleeping partner and also had sex with a 15-year-old boy has been sentenced to eight-and-a-half years in a West Australian prison.

The 37-year-old, who cannot be named, was in a “toxic relationship” that had deteriorated when he committed the rape, the WA District Court heard on Wednesday.

Judge Hylton Quail described it as a “gross act of betrayal”.

“The recording was brazen and made for your own prurient purposes,” he said.

“He would have been embarrassed and concerned by who else might have seen the recording.

“It wouldn’t surprise me if it takes him years to recover from the betrayal.”

The victim found the recording but he did not immediately report the crime to police.

The video was later found by police while they were investigating the man’s crimes against the teenager.

At his trial, the man claimed his then-partner was “faking sleep” as part of a role play.

Judge Quail did not accept the man was remorseful for any of his offences, adding that the man knew the boy was underage but did not care.

“You took advantage of a vulnerable young man who had numerous problems of his own,” he said.

Judge Quail also noted both victims had suffered mental health issues as a result of their sexual assaults.

The man, who was found guilty of aggravated sexual penetration without consent and two counts of sexual penetration of a child, must serve at least six-and-a-half years behind bars before he can be eligible for parole.

His parents attended court and remain supportive.
